Supervisory Proceeding – an Extraordinary Stage of Civil Procedure

The research paper is going to cover a topic of the supervision proceedings as an extraordinary stage of the civil procedure in the Russian Federation. This paper attempts to show that legal approaches to determining the nature of the supervisory agency depend on the specific historical stage of development of our society and state. To add to this the redefinition of the essence of the institute has greatly increased in recent years under the influence of European-legal standards of justice, including the approach to the extraordinary appointment of the reconsideration of a judgment in the exercise of supervisory powers, which can be used in rare and exceptional cases. Thus this paper focuses on the receiving updated information on the unique features of Russian supervisory agency that distinguish it from similar institutions in other countries. For this purpose on the basis of the comparative analysis features of revision of the judicial decisions which have entered validity in the legislation of Russia and other European states are investigated. At the end this research aims to obtaining a result that can be used to improve civil procedural legislation in Russia. Singled out effective mechanisms to foreign legislation and appeals procedures, introduction of which into national law is acceptable and appropriate .
