The Problems of Protection of Musical Compositions as a Part of Complex Objects of Intellectual Property

The usage of music compositions, both originals and remakes, is spread widely nowadays all over the world, especially in TV programs, movies, and videos, on the Internet. In such realities, copyright protection of composers and other copyright holders of music compositions is really essential. The author of the graduation work sheds light on precautions that should be taken by creators for legal including music in films, other audiovisual compositions, multimedia products, theater performances and other complex objects. Over the past few years, the most astounding cases referring to copyright protection of copyright holders of music compositions in Russia were devoted to using music remakes in TV programs, videos. Such cases are the basis of the study and they are analyzed in detail in the graduation work. Producers of complex objects often believe that the consent of the copyright holder of a music composition is not required, and it is enough to sign a license contract with Russian Authors Society, which controls exclusive rights and takes fee on the behalf of the copyright holder. Special attention in the work is devoted to composer’s remuneration, when his or her music composition is utilised in public performance or in airtime and cable message.

The full text of a thesis can be published in open access on the HSE website only if the authoring student (copyright holder) agrees, or, if the thesis was written by a team of students, if all the co-authors (copyright holders) agree. After a thesis is published on the HSE website, it obtains the status of an online publication.

Student theses are objects of copyright and their use is subject to limitations in accordance with the Russian Federation’s law on intellectual property.

In the event that a thesis is quoted or otherwise used, reference to the author’s name and the source of quotation is required.
