Applicable Law in International Investment Disputes

The paper is devoted to the issue of applicable substantive law in international investment disputes between states and private foreign parties. The author considers the principle of parties’ autonomy and its limits as well as the powers of arbitral tribunals in determining the applicable law in the absence of an agreement on applicable law between the parties. Moreover, the author illustrates by references to the international investment case law the difference in approach to the interplay between national and international rules of law which could be determined by the investment tribunals as applicable to the dispute.
