Protection of Famous Marks in International Intellectual Law

Abstract. The aim of the master's thesis is to study the provisions of international law, regional treaties and agreements, as well as the legislation of the Russian Federation with respect to well-known trademarks and their protection. The analysis of concepts and methodological materials carried out within the framework of the study showed that there was a wide range of problems when applying traditional provisions of the applicable legislation to such a separate category of trademarks as well-known trademarks. The relevance of the study is due to the fact that some trademarks, as a result of their long use, effective advertising campaign for decades and high quality, not only have received recognition in the market and the status of "well-known", but also have become objects of unfair use by violators. Particular attention is paid to the protection of trademarks that are not registered on the territory of Russia and to the protection of signs used for heterogeneous goods, as well as the influence of the factor of dishonesty on the protection of trademarks.
