Provisional Interim Measures in Arbitral Proceedings

The purpose of the work is to study the nature and legal regulation of preliminary interim measures as a form of procedural protection of rights and interests of in commercial stream participants. The "two-tier" model on the issue of preliminary provisional measures/interim measures, proposed by the author, has advantages considering the formulated subject of proof and taking into account the balance between the effectiveness of preliminary provisional measures and the interests of the defendant. The incentives - predetermining the behavior of the participants in the trial - were taken into considiration. At the same time, the hypothesis of the lock-in effect is proposed due to the awarding the judgement, which requires further research, including empirical study.
