Constitutional Basis of the Budget Process

This paper deals with constitutional bases of the budget process. On the base of the analysis of the constitutional provisions the author determines the constitutional grounds for budget process. By characterizing and analyzing the legal rules the author concludes that there are differences in the budget process in Russia and foreign countries. The author describes fundamental constitutional principles for budget process and concludes that in the Russian Federation many of them are stipulated by the Constitutional Court of the Russian Federation. The paper also examines various approaches to the regulation of the financial and budget legal relation, specifically one of them suggests the presence of a separate Chapter in the Constitution devoted to the budget relations, while the other implies its absence.
