The Availability and Efficiency of Justice in Civil Cases

This research aims to elucidate the features of access to justice and to define its efficiency. By examining doctrinal sources and federal legislation, formal and comparative methods, we will emphasize the significance of this principle as part of the law-governed state. It is expected that one of the major obstacles for the practical implementation of these principles is the absence of common understanding and legal regulation. The research examines definition of access to justice in national and ECHR’s judgements. Furthermore, the research focuses on generally-established standards of efficient access to justice in civil cases and their impact on system of justice in general. Then, efficiency of justise, its criteria and reasons, which decrease it are analyzed. Finally, alternative ways of resolving problems in this scope are summarized.
