Legal Regulation of Cross-Border Payment Transactions Using Electronic Money

The work is devoted to the study of legal regulation of cross-border settlement transactions with the use of electronic funds. In the framework of the research, the author set the following tasks: a) identification of the legal nature of electronic money and its use in the implementation of cross-border settlement transactions; b) identifying the characteristics of the implementation of payments using electronic money, identifying the necessary infrastructure for conducting cross-border settlement transactions using electronic money; d) defining the basis for legal regulation of international electronic payment systems.

Based on the results of the research, the author comes to the conclusion that the main advantage, and together with this and the minus of transactions with electronic money is considered to be inability to use them as a means of payment outside electronic systems. In addition, the author separately notes that the definition of the legal status of electronic money in the context of cross-border settlement transactions with the use of electronic funds directly affects the peculiarity of their legal regulation, as well as the need to create a certain payment infrastructure, given the experience of regulation in the US and the EU.
