Problems of Bringing to Justice of the Debtor Controlling Person

The construction of the legal entity allows its participants not to answer for the obligations of this entity (the principle of isolation). However, in the science of civil law there is an institution of subsidiary (additional) responsibility, the essence of which is to transfer the civil liability from a legal entity to its participants (controlling persons). In the legislation, this mechanism is expressed through the norms of the Civil Code of the Russian Federation and a number of other federal laws. In this paper we present an analysis of these norms, the practice of their application, and also the well-known principle of "piercing the corporate veil" and the ways of its implementation in the Russian legislation.
