Liquidated Damages under Russian Law

In this paper, the author analyzes the application of the design of pre-estimated losses in the countries of continental and Anglo-American legal families, gives a generalized concept of pre-estimated losses. The author makes an attempt to analyze the possibility of applying the construction of the previously estimated losses in the contracts under Russian law, the legal nature of such construction in its implementation in civil law. A positive conclusion is made about the possibility of implementing this design in the Russian legal system, despite the presence of currently unsystematic application of the this design by the courts
