Constitutional Design in the Theory of Modern Constitutionalism

The Constitution (from the English language “constitution” - the structure, composition, addition, configuration) in the comprehension of modern Western researchers is perceived as more than just an act that has the highest legal force. First of all, in the many sources it is noted that the constitution is a liberal document. On the one hand, its action is aimed at the assertion of the rights and the individual’s freedom, and on the other hand, it is the restriction of state power. From the standpoint of this approach, consideration should be directed to the study of its essence. Any constitution represents a certain system of the legal norms that interact with each other. The ways and methods of design of this system are called the constitutional design of the fundamental law. The paper analyzes the expediency of using the concept of "constitutional design" in the context of Russian constitutional law and the concept of constitutionalism, as well as the main directions for the development of new ideas of the direct democracy.
