Legal Status of Notary

Currently, the notary’s institution remains under discussion in the Russian Federation. The reason of this lies in the legal regulation of the notary’s legal status, which is the basis for the effective implementation of notarial activities to protect citizens and legal entities rights. This research aims to identify the structure of the notary’s legal status as a complex legal category and to make the analysis of its main elements. This project addresses the issue of the place for the notary in the system of public authorities. A special attention is paid to the uniform nature of the public and private notary, which makes it possible to consider the Russian notary as a single system which is based on the common principles and performing the same functions. The investigation is based on a variety of methods such as the analysis of the court practice and the analysis of the Russian legal norms. The expected results may lead to a better understanding of the notary's institution, the role of the notary and its legal status, as well as the basic elements. In the future, it seems appropriate to give impetus to the formation of a new legislative framework, which will, in general and precisely, regulate legal relations in the notarial law.
