Legal Protection of Trademarks on the Internet

The rapid development of the Internet in recent decades has led to the development of e-commerce and the emergence of new ways of using trademarks in the cyber space. However, along with the growth in the scope of use of trademarks, increases the scale of the respective violations, and as a result, the problem of protecting the rights and lawful interests of trademark holders from the illegal use of their trademarks on the Internet is especially acute. The purpose of the work is to conduct a comprehensive analysis of the use of trademarks in the Internet and ways to protect rights holders from the illegal use of their trademarks within the framework of Russian legislation and law enforcement practices, as well as highlighting current problems in this area and making some suggestions for their improvement. In this work the ways of using trademarks in the Internet are analyzed in detail, including their use in domain names, search engine advertising, meta tags, the content of the website, as well as ways to protect rights holders from violations of their rights to trademarks are outlined. Some drawbacks of the provisions of part four of the Civil Code of the Russian Federation regulating trademarks as well as of positions formulated by judicial practice are outlined, and possible ways of their improvement are suggested, including by borrowing some foreign experience.
