Tenancy Contract in Revenue Houses: History and Today Views

The right to housing is enshrined in the Constitution of the Russian Federation and it is one of the fundamental human rights. In the 2014 a new Institute of tenancy contract in revenue houses was introduced in Russian legislation, and the main aim of it is to improve the housing situation in the country.

The purpose of the thesis is to analyze the legal relations developing in the sphere of rental agreements, to analyze Russian and foreign legislation governing these legal relations, to form the system of knowledge about the tenancy contract in revenue houses and to identify the possibility of its integrating into Russian reality.

To achieve this goal, the following objectives were designated:

1) study the historical development of the tenancy agreement in apartment buildings in Europe and consider how is this institution of rent in European countries arranged;

2) study the historical development of this agreement in Russia;

3) discuss whether such type of rental contract is needed in Russia, if so, what steps should the legislator take to introduce it into Russian reality;

4) find out differences between tenancy agreement in revenue houses and other types of rental contract;

5) assumption of its main characteristics;

6) identification of some theoretical and practical problems and ways to overcome them.

The results of this work are: 1) comprehensive analysis of the tenancy contract in revenue houses, 2) offering of concrete solutions for theoretical and practical problems which were identified in the research.
