Peculiarities of Consideration and Resolution of Disputes in the Sphere of Environmental Protection

In the light of national strategic priority of the preservation of environmental well-being, there is a pressing issue of how to realize and protect ecological rights effectively. Specificity of the designated social relations can be explained by duality of their legal nature. On the one hand, ecological legal relations affect the public interest, but at the same time it is essential to protect private interest. Alongside with that, the problem of dispute resolution mechanisms and practical difficulties of their realization in the field of nature protection is equally important and pressing in judicial practice. The present research is aimed to concentrate on procedural peculiarities of environmental disputes. Firstly, the paper focuses on the theoretical background: legal nature and content of the disputes; classification, issues of judicial competence, possible participants of the controversy. Afterwards, the research describes practical peculiarities of consideration and dispute resolution. The present paper considers resolution of environmental cases in the first instance court under Arbitral Procedural Code of the Russian Federation and Civil Procedural Code of the Russian Federation.
