The Conception of Restorative Justice in Criminal Proceeding

At the present stage of development of civil society, the formation of the rule of law in Russia, there is an urgent question of the development of criminal justice and the search for new approaches to both the assessment of crime and sentencing. As noted by many lawyers, this is due to the fact that currently there is a crisis of the traditional punitive model of criminal justice. An alternative to the punitive paradigm of criminal justice is restorative justice, which offers a different approach to responding to crime. The Central idea of restorative justice is not to punish a person, but to reconcile the parties, to jointly resolve issues that have arisen in connection with the Commission of a crime. This work is devoted to the research of the Institute of restorative justice. The purpose of the master's thesis is to study approaches to the resolution of criminal law conflicts on the basis of reconciliation, analysis of existing programs of restorative justice in foreign countries, confirmation of positive experience and justification of proposals in favor of the introduction of mediation in criminal cases in the criminal proceedings of the Russian Federation.
