Special Assessment of Working Conditions: Theoretical and Legal Aspects and Current Problems of Law Enforcement

The work considers the mechanism of the work of the procedure for the Special Assessment of Working Conditions (SOUT). Regulatory documents regulating the procedure, rights and obligations of the parties during a special assessment of working conditions are considered. The judicial practice in the field of SOI is explored, and the main problems in law enforcement are identified, both highlighted on the basis of judicial acts and on the basis of the opinions of specialists in the field of labor law. We study the foreign experience of professional risk assessment, the availability of procedures similar to the Russian special assessment of working conditions, as well as the most often arising in connection with this lawsuit. In the course of the work, a clear notion of the concept of the special assessment procedure was formulated, on the basis of which and in comparison with which proposals were developed for optimizing the operation of this mechanism in Russia.
