The major purpose of this study is to develop an understanding of comprehensive vision of the concept of vicarious liability of the persons controlling the debtor for bringing to bankruptcy by prejudicial transactions. The problem of defining the peculiarities of the updated mechanism for bringing a person to vicarious liability, as well as identifying legislative gaps, unresolved issues and potential abuses of the right within the framework of the institution of subsidiary liability, is covered.
