The Disclosure of Evidence in Procedural Law of Russia, the United Kingdom and the United States of America

The project comparatively analyzes the institution of discovery of evidence in the civil and arbitration process. It means the phase in a lawsuit, in which each party can request documents and other evidence from other parties and can compel the production of evidence by using a subpoena or through other discovery devices. The author examines this procedure in the legal systems of common-law jurisdictions (specifically the USA and England) and consider the nature of the similar principle of Russian procedural legislation. In addition, measures of responsibility in case of violation of requirements to procedure are analyzed. The aim of the study is to identify the benefits and drawbacks of this procedure, as well as its applicability to Russian realities. The research is conducted by means of comparative, sociological and “black letter” approaches. The conclusions to which the author comes can be applied to the preparation of legislation in the field of procedural law, as well as theory.
