International legal regulation on compulsory licensing of patented pharmaceutical products

This paper analyses the current international legal trends in the development of the institution of compulsory licenses for pharmaceutical products, as well as the directions of the application of main international principles by different states and the consequences of such an application. The main focus is on the provisions of the TRIPS Agreement, the Doha Declaration, the legislation and legal cases of the five states under consideration. In addition, the paper analyses the ambiguous aspects of compulsory licensing - its impact on innovation and investment in R & D and the impact of TRIPS-plus Agreements on it.
