The diploma thesis is devoted to problem of freedom of speech in democratic society and its restrictions. I try to prove that freedom of speech is not only right of human, but also one of the principles of constitutionalism because functioning of state institutions like partiament, political parties and elections, is impossible. However, the text is mostly devoted to restrictions of freedom of expression: there I write about conditions when they are possible and necessary.

In main part I describe different restrictions of freedom of speech and look for right balance between prohibition of hate speech and freedom of expression, and I also wrote briefly about detraction and punishment for it.

Another chapter of the thesis is devoted to restrictions of freedom of speech, connected with sharing opinion about historical events.

Final chapter is devoted part of criminal law which establish punishment for crimes connected with abuse of freedom of speech. The thesis would be impossible without it, because restrictions cannot be realized in practice without criminal penalty for trespass of this right of human. In this part of my work I wrote how criminal penalty for such crimes should be and explained how relevant articles of criminal code should be reformed to make realize principal of clearness of law.

Finally, I should say that I chose this topic because all my scientific texts are devoted to problem of freedom of speech and its restrictions. So, I wanted to make this thesis summary of my work about this issue during the studying for bachelor`s degree.
