The Features of Criminal Prosecution in Cases of Private Charge in Russia

This research is devoted to the features of private prosecution at the institute of criminal prosecution. In the realities of modern Russian criminal procedural relations private prosecution plays an important role because it bears dispositive principles. However, for almost two decades of the functioning of the criminal prosecution in cases of private charge in the Russian Federation, it has not received a clear legislative fixation. In practice, law enforcement officers make mistakes due to gaps in the criminal procedure legislation. This research is aimed at analyzing the legal nature of the criminal prosecution in cases of private charge, a detailed analysis of the meaning of the statement of the victim because the victim is a private prosecutor, the procedural stages of initiating a criminal case in private charge and the court proceedings. The conclusion is based not only on the basis of process scientists` researches, but also on the basis of judicial practice and judicial statistics.
