Cross-border Financial Instruments Transactions in International Banking Law

The paper is devoted to the regulation of cross-border transactions in financial instruments under international banking law. The author approaches the issues related to the regulation of cross-border circulation of securities and derivatives. The subject matter is illustrated by existing doctrine and case law. The author comes to the conclusion, that the development vector of the regulation of cross-border circulation of securities lies at the basis of the development of conflict of laws regulation at the international level, circulation of derivatives – in harmonization of legislation at national levels in accordance with existing international standards.
