Limits of Considering a Case in the Appellate Instance of the Commercial Court

Theoretical model of appellate proceedings in a commercial court has been developed. The concept and signs of appellate proceedings as well as the types of appeal in the theory and history of procedural law were reviewed. The paper describes the limits of considering a case in the appellate instance of the commercial court, including the limits of examining evidence and verification of a judicial decision in the court of appeal. Due consideration was given to the problem of filing new claims to the commercial court of appeal. Special attention was paid to practical problems of transition of the commercial court of appeal to considering a case according to the rules established by the Commercial Procedure Code of the Russian Federation for trial courts. Analysis was made of the court practice of the commercial courts of appeal relating to the issues of accepting new evidence and transition to considering a according to the rules established by the Commercial Procedure Code of the Russian Federation for trial courts.
