Interaction of Treaty and Contractual Investor's and State's Rights Protection Mechanisms

This paper is aimed to find and describe the relationship between an international investment treaty and an investment contract. The study is motivated by the crisis of the investment law system and has as its goal to offer a solution to the problem. The description of the relationship between an international investment treaty and an investment contract consists of two main blocks. The first block is aimed to investigate and formulate theoretical theses in the field of international law and international investment law. The second block is intended to describe the practice of application of two types of treaty provisions - an umbrella clause and a fork-in-the road clause. As a result of the study, author is trying to prove that an international investment treaty and an investment contract are in systemic connection, and only in such a connection they effectively ensure investment relations.
