Legal Regime of Publicly Available Personal Data

The paper is devoted to the problem of the definition and regulation of publicly available personal data in the Russian Federation and other countries, identifying differences in approaches to regulating the processing of publicly available personal data, as well as proposing possible solutions to improve legislation of the Russian Federation. The paper analyzes the legislation of the Russian Federation in the sphere of publicly available personal data, judicial practice, acts of the executive authorities, as well as the opinion of researchers in law. Legal regulation of the European Union and Singapore was chosen, since the European Union and Singapore belong to the centralized system of legal regulation of personal data, but have different approaches to regulating the processing of publicly available personal data. This work scrutinizes correlation between publicly available personal data and personal data made publicly available by the subject of personal data, and also considers publicly available sources of personal data and open sources as a form of presenting publicly available personal data. Finally, legal lacunae in the legal regulation of publicly available personal data in the Russian Federation were identified, on the basis of which possible ways of improvement of the legal regulation were suggested.
