Recognition and Enforcement of Foreign Arbitral Awards in Russian Federation

This work is devoted to the recognition and enforcement of foreign arbitral awards in the Russian Federation. The issue of recognition and enforcement of foreign arbitral awards is the most significant in international civil procedure law because at this stage of the proceedings there is a final settlement of the dispute between the parties, included in the material satisfaction of the plaintiffs’ claims. However, the practical complexity of the issue is as follows: the judgement is rendered by the public authority of one state, within the jurisdiction of the concerned state; it is recognized and enforced in the territory of another state, which entails the non-proliferation of the above-mentioned public authority in the territory of that state. The diploma consists of the introduction, two chapters, two paragraphs, conclusion and bibliographic list. The first chapter of the work covers the procedure for recognition and enforcement of foreign arbitral awards in the territory of the Russian Federation. The second chapter discusses the grounds for refusal to recognize and enforce foreign arbitral awards on the territory of the Russian Federation. The aim of this work is a comprehensive analysis based on the court practice, the procedure of recognition and enforcement of foreign arbitral awards in the territory of the Russian Federation, as well as the grounds for refusal to recognize and enforce arbitral awards. The object of the study is a set of legal relations that are associated with the recognition and enforcement of foreign arbitral awards. The subject of the study are the rules contained in the legislation of the Russian Federation on arbitration proceedings of the Russian Federation, international treaties and international doctrine.
