Problems of Legal Regulation of Franchising, Franchisee and Consumer Protection and Possible Solutions

The purpose of the research is to draw conclusions about the manifestations of the imperfection of the legal defense of a consumer and a franchisee in relations with a franchisee and a franchisor respectively and the search for possible solutions to the problems found. The legislation, the most relevant literature and judicial practice were studied. Franchising and its historic, theoretical and comparative law aspects were examined. Legal status of both franchisee and consumer had been reviewed. Also consumer relations in general were characterized. The analyses of judicial practice played a key role. It indicated issues in legal protection of franchisee and consumer in Russian legal system. In this context, it is proposed to introduce some measures that could lead to better legal protection of parties’ rights.
