Legal Regulation of Labor of Foreign Workers in the Russian Federation

The graduation qualification work is devoted to the legal regulation of labor of foreign workers in the Russian Federation. The goal of this research is a comprehensive study of the legislation in the sphere of legal regulation of labor of foreign workers, as well as the identification of problems and special aspects related to the employment of this category of workers. This aim is achieved by solving a number of objectives, the most significant of which are: 1) To define the concepts of “foreign worker” and “migrant worker” and identify their co-relation; 2) To analyze the Russian legislation governing the labor of foreign workers; 3) To consider the contemporary issues of the usage of a labor of foreign workers; 4) To determine the features of the conclusion, amendment and termination of the employment agreement with a foreign worker. In this work, were used the comparative legal, logical-analytical and system-structural methods to study legal processes in the field of migration policy. This study analyzed the statutory enactments governing the procedure for foreign workers to work activities in the territory of the Russian Federation. The special aspects of the legal regime of labor of foreigners are shown, similarities and differences of the scope and content of labor rights that are conferred on Russian and foreign citizens are revealed. The issues of the institution of administrative responsibility for violation of the rules governing the labor activities of foreign citizens are touched upon. The author also examined in detail the features of the conclusion, amendment and termination of employment contracts with foreign workers.
