Arbitrability of Corporate and Public Procurement Disputes

The paper is devoted to the problem of arbitrability of corporate and procurement disputes in Russia. The paper focuses on exploring the possibility of resolving two types of disputes in the arbitration. In accordance with the recent amendments, corporate and procurement disputes are arbitrable, but with certain exceptions. A proper understanding of these provisions will allow avoiding situations of non-enforcement of arbitral awards by the courts. The main aims of the research are to determine the range of corporate and procurement disputes, which can be resolved in arbitration in Russian law, an attempt to understand what are the significant problems facing the future corporate and procurement disputes and try to suggest solutions. Besides, the supplementary goal of the paper is to contribute to the development and popularization of arbitration as an alternative way of dispute resolution.
