Electronic Evidence in Civil and Commercial Procedure

The paper is devoted to the study of the institute of electronic evidence in civil and commercial proceedings. This work is a comprehensive study of the legal nature of modern sources of information as evidence, and also contains suggestions for improving modern Russian procedural legislation. In the course of the study the following tasks were accomplished: to study the legal doctrine within the scope of the subject of the study, to identify features that allow to distinguish electronic evidence from other types of evidence; to analyze the current Russian procedural legislation and judicial practice; to study the doctrines of the USA, England and Wales. As a result of the study, the conclusion was made that the current Russian procedural legislation does not correspond to demands of modern life and that there is an urgent need for procedural reform aimed at introducing electronic evidence as an independent means of proof.
