Legal Regulation of the Recognition of Debtor’s Transactions Committed to Detriment of Creditors as Invalid in Bankruptcy

The paper is devoted to the institute of competitive challenging of the debtor's transactions committed to the detriment of creditors. As part of the research, both theoretical and practical aspects of competitive challenging of the debtor's transactions were touched upon. The origin of the institute of competitive challenging is examined, the concepts developed in the private law doctrine justifying the creditor’s right to void debtor’s transactions are highlighted and analyzed. In addition, the paper examines the existing grounds and procedure for contesting transactions, illustrated by court cases, and draws analogies with the approaches that exist in foreign legal systems. Finally, an analysis was carried out of the legal consequences of declaring the debtor’s transactions void. Attention was paid to the differences in the consequences of invalidity of transactions on civil grounds and on the grounds provided for by Chapter III.1 of the Federal Law "On Insolvency (Bankruptcy)".
