The fundamental thesis of this scientific project is idea that institute of provisional measures in Russian civil procedure requires reforms concluded in implementation of effective legal rules, which are formed by American civil law experience. Scientific research of this issue may be caused by the obligatoriness to reform the national legislation, exactly the procedural protection of citizens in order to ensure the interests of the affected parties in the process. The relevance and practical aspect of identifying trends in the implementation of the norms regulating the institute of interim measures of American law into the Russian system is connected with the need to develop and effectively transform this institution on the basis of positive foreign experience. In the field of practical application of the institution of interim measures it is relevant to adopt again the application of the relevant legal instruments in the United States of America, since in this system interim measures are the fundamental basis for the fair, effective and timely resolution of a civil dispute. The issue of effective implementation of foreign practice in order to develop a system of guaranteeing the interests of the claimant through the use of interim measures is very relevant. The relevance of the topic of the thesis is associated with a significant spread of the phenomenon under study and there is a necessity to develop recommendations for improving the effective functioning in this area.
