Contingent Labor in Russia and Foreign Countries

The work is devoted to the study of contingent labor as one of the atypical forms of employment, the appearance of which was caused by social changes. The paper analyzes the position of contingent labor among other non-standard forms of employment, and also determines its key characteristics, gives an assessment of its use from the point of view of the consequences for the parties to labor relations and their impact on them. Despite the legislative prohibition of contingent labor in Russia, the similar construction of personnel provision can be considered essentially as one of its varieties. The design of the provision of personnel was enshrined in the law in 2016, the work identifies the entities involved in the provision of personnel, what requirements are imposed on them, cases where the provision of personnel is possible and the conditions necessary for this, what guarantees for the parties to labor relations are fixed by law. Also analyzed the judicial practice, identified problems encountered in law enforcement. The paper studies the legislative regulation of contingent labor in foreign countries and its international regulation, the author comes to the conclusion that the contingent labor in various forms is widespread in the world. In general, it can be concluded that the design of the provision of personnel in Russia complies with international standards, however, its further reforming is necessary taking into account theoretical studies, law enforcement practice and experience of foreign countries.
