The Legal Status of a Bankruptcy Trustee in a Bankruptcy Case

The procedure used in bankruptcy proceedings is dominant among others in its complexity, volume, frequency of application. The central figure of the bankruptcy proceedings is the bankruptcy trustee. The bankruptcy trustee is responsible for conducting the procedure of bankruptcy proceedings and achieving the objectives of the procedure. In the present work, a comprehensive study of aspects of bankruptcy proceedings, from the introduction of the procedure of bankruptcy proceedings and the appointment of the bankruptcy trustee, to the implementation of the bankruptcy trustee's legal position, as well as the removal and release of the bankruptcy trustee from the performance of its duties. In the course of the study, it was proposed to create a system for collecting information on the professional activities of arbitration managers, made a proposal to reform the procedure for the sale of the debtor's property, indicated the need to make changes to the competence of the bankruptcy Trustee on the issue of conducting business by the debtor, and also proposed to unify the grounds for the removal of the arbitration manager from the performance of his duties in the bankruptcy case.
