The Measures to Prevent the Insolvency (Bankruptcy) of a Legal Entity as a Debtor in Russian Federation

Currently, the problem of reforming the legislation on the prevention of insolvency (bankruptcy) of a debtor-legal entity is particularly relevant, as evidenced by the bill on amending the Insolvency (Bankruptcy) Law under consideration by the State Duma of the Russian Federation No. 239932-7. The paper analyzed the problems of judicial and pre-trial procedures for the prevention of bankruptcy. The analysis showed that pre-trial measures are currently practically not applied due to the lack of due legislative regulation. The solution to the problem of the low applicability of rehabilitation bankruptcy procedures is to apply an integrated approach to the institution of insolvency prevention in general. Expansion of measures on this issue is possible by combining a pro-long and pro-creditor approach as in the laws of countries with developed market economies.
