Аnnotation SECTION OF CORPORATE RIGHTS AND RESPONSIBILITIES OF SPRINGS This work is devoted to doctrinal and law enforcement problems of the division of corporate rights and duties of spouses. The current situation is primarily due to the intersection of several areas of social relations - corporate, family law, and in some cases hereditary. In this regard, in practice, there are many legal conflicts that require doctrinal and legal justification for their resolution. The latter, as a rule, arise in connection with the fact that the spouses have common property, which includes a share in the authorized capital of the LLC. At the same time, the line between the disposal of common joint property (in particular, when it is divided) and the legitimate realization of corporate rights by spouses is very thin, which determines a large number of uncertainties in law enforcement in this area. In addition, the situation becomes more complicated when it comes to the inheritance of a share in the share capital of an LLC by a surviving spouse, who also has a hereditary right to a share and a right to a part of this share arising from the legal regime of joint ownership of the spouses. The study analyzed theoretical and law-enforcement problems arising from the division of corporate rights and duties of spouses on the example of a limited liability company, as well as the search for their solution by developing proposals for improving Russian legislation.
