Peculiarities of Proof in Copyright Infringement Cases

The judicial order o fcopyright protection is the most effective and comprehensive way to do it. At the same time, the crucial role for any case plays proof process. The purpose of this final qualifying work is to study and identify the peculiarities in cases of copyright infringement, the analysis of the court position and the formation of proposals for improving the legislation in this field. The main objectives of the study: - Determine the legal nature and subject of proof, its structure, as well as the peculiarities of its formation in cases of copyright infringement; - Investigate the subject composition of participants in cases of copyright infringement, in particular the procedural status of organizations exercising collective management of rights; - Consider the circumstances included in the subject of proof in most cases involving copyright infringement; - To give a general description of the means of evidence used in the resolution of these disputes.
