The Evidence and Proof of Employee Guilt in Bringing Him to Disciplinary Responsibility

The work is primarily devoted to the study of the procedure for bringing an employee to disciplinary responsibility, analysis of evidence of his guilt in the Russian labor law and judicial practice, consideration of differences between different types of penalties provided for in part 1 of article 192 of the Labor code of the Russian Federation, as well as the study of the problems of legislation in the field of bringing an employee to disciplinary responsibility on the basis of the most striking cases from the Russian judicial practice. The labour legislation is still not resolved the issue with the interpretation of the observations and of the reprimand, which, along with the casuistry of a labour dispute and the excessive discretion of the employer in the sphere of choice of disciplinary sanctions does not allow to identify the most successful tactics to present its case in court. The author tries to understand the Russian labor legislation and gives recommendations not only on the most effective evidence of the employee's guilt in a court dispute, but also proposes changes to Chapter 30 of the Labor code of the Russian Federation.
