The Features of Legal Regulation of Labor Relations in Religious Organizations in the Russian Federation

Modern Russian regulation of labor relations in religious organizations is distinguished by a number of features, primarily related to the constitutional principle of secularism and the unique characteristics of religious organizations as subjects of labor law. In addition to state norms, labor in such organizations is also regulated by internal regulations. At the moment, we can state that there is a wide autonomy of religious organizations in matters of attracting wage labor, and, in practice, this often leads to violations of the rights of workers. The purpose of the study is the most complete and widespread consideration of the features of domestic regulation of labor relations complicated by the religious element and rethinking the existing regulation from the perspective of the interests and rights of religious organizations staff. This paper analyzes the legal and internal regulation of labor relations in religious organizations. The problem of non-typicality of religious organizations acting as employers is highlighted, staff involved in the functioning of a religious organization is categorized. What is more, the author explores the features that arise during the conclusion, execution, and termination of labor contracts in religious organizations, the specificity of the status of clergy, as well as the process of resolving labor disputes.
