Risk-Oriented Approach in the Regulation of Concession Agreements

The purpose of this master's thesis is to develop a risk-oriented approach to the regulation of concession agreements. To achieve this goal, this paper identifies the essence of risk and its importance for the legal regulation of concession agreements; formulates the procedure for identifying and assessing risks; systematises the risk management procedure; defines effective criteria for the allocation of risks between the parties of the concession agreement, taking into account the definition of the legal nature of concession agreements; as well as in this paper developed proposal to improve the legislation on concession agreements on the basis of the risk-oriented approach.
