Problems of Challenging the Debtor's Transactions in the Framework of the Insolvency (Bankruptcy) Case

To date, the rules governing the debtor’s bankruptcy procedure are designed in such a way that they are strongly designed to protect the interests of the rights of creditors in a bankruptcy case. Creditors are provided with a wide range of protection of their interests, through replenishment of the competitive mass. But, disputing the debtor’s transaction, and recognizing it as invalid, affects the rights and interests of the party in whose favor the contested transaction was made. Thus, there are diametrically opposed interests between the debtor, registered creditors and creditors whose transactions are disputed. The master's thesis is devoted to finding conditions for a balance of interests of all persons involved in a bankruptcy case, on the basis of which new grounds for challenging are modeled, which make it possible to increase the efficiency of protection of the rights of registered creditors, contragents and the debtor.
