Regulation of Labor of Foreign Citizens in the Field of Physical Culture and Sports in the Russian Federation

The entry into force of the Treaty on the Eurasian Economic Union, as a consequence of the new international legal regulation of labor relations, including in the field of sports, predetermine the novelty of the master's thesis. In this case, the issue of restrictions on the participation of athletes in official competitions will be revealed no longer in terms of the practice of sports law enforcement agencies, but through the plane of obligations that the Russian Federation has taken due to membership in the Eurasian Economic Union (EAEU). These obligations affect the work permit for foreign specialists. Improvement of legislation and regulatory standards in this part in the future can serve as a basis for changing the understanding of the term "legionary" and its applicability to citizens of certain foreign countries. The current legal and regulatory regulation in a certain part forces clubs to enter into employment contracts with sportsmen who are citizens of the Russian Federation. Formally, the mechanism for limiting the number of foreign workers by virtue of a special provision of art. 16 of the Law on Physical Culture is legitimate, however, restrictions imposed by all-Russian public organizations on the participation of athletes in official competitions apply to all foreign athletes, including citizens of the EEU member countries and the EU, which directly contradicts international treaties ratified by the Russian Federation. In this case, the Russian court has all reasonable grounds to recognize the limit established by the regulations and regulations in Russian competitions, which discriminate against working conditions on national grounds, contrary to international treaties and agreements ratified by the Russian Federation, and therefore unacceptable.
