Civil law of the modern period in its development process continues to rely on the basic principles of civil law regulation of legal relations, which, in particular, manifests itself in the development of relevant legal institutions, one of which is the institution of mediation. Today, our society, the legislator, and the international community are striving to find the most effective way of resolving legal conflicts, and, based on this, the world view has become the question of the nature and mechanism of their resolution. The concept of "mediation" comes from the Latin "mediare" - to mediate. Mediation is a kind of negotiations with the participation of a third, neutral party, which is only interested in the parties to resolve their dispute (conflict) as directly as possible to themselves. The institute of mediation is gaining more and more popularity in the process of conflict resolution, both private law and international law.

Student Theses at HSE must be completed in accordance with the University Rules and regulations specified by each educational programme.

The full text of a thesis can be published in open access on the HSE website only if the authoring student (copyright holder) agrees, or, if the thesis was written by a team of students, if all the co-authors (copyright holders) agree. After a thesis is published on the HSE website, it obtains the status of an online publication.

Student theses are objects of copyright and their use is subject to limitations in accordance with the Russian Federation’s law on intellectual property.
