Evidence and Proof in International Commercial Arbitration

The research is dedicated to particularities of evidence and proof in international commercial arbitration. Behavior economics and law&economics being non-traditional approach for research of evidence give fresh eyes for the theme. With respect to new kinds of evidence, such as e-documents, are defined the extent of using them in disclosure/discovery. In the paper is defined the role of «soft» law in arbitration and specificities of applying legal rules from common law and civil law in arbitration. Also the research contains a detailed analysis of the IBA Rules on the Taking Evidence in International Arbitration and Prague Rules on the Efficient Conduct of Proceedings in International Arbitration.
