Material Liability Between an Employer and their Employee

The thesis is dedicated to the study of the institution of material liability between an employer and their employee in the Russian Federation. The relevance of the study is due to the fact that at present many researchers have noted that the boundaries of employee liability are expanding, and as a result, the position and powers of the employer regarding his employee are being strengthened. The subject of the research are legal norms covering material liability of an employee and employer, the practice of applying these norms and the scientific works of Russian scientists devoted to the study of this institution. This work consists of an introduction, three chapters, which include 11 paragraphs, conclusion and bibliography. The first chapter is devoted to the analysis of the theoretical aspects of material liability of the parties to an employment contract and the history of formation of this legal institution. In the second chapter, the features of an employee’s liability are considered along with the conditions for the occurrence of full individual and collective material liability. The third chapter is devoted to the analysis of cases where an employer is liable for the infliction of property and moral damage.
