Employee\'s Guarantee During Termination of Employment Contract

The relevance of the work is underpinned by the demands of development of modern regulation mechanisms of the employee assurance issues during the termination of employment agreement. The research objective is the revealing of regulatory framework of an operating mechanism is labor law in regard to employee assurance during the termination of employment agreement, problematics of enjoyment of the rights and the development of an operating mechanism. To achieve the objective we had to deal with the following primary targets: · to explain the notions ‘termination’ and ‘dissolution’ of employment agreement; to classify the employee assurance under the termination; · to research the problematics of realization of the employee assurance under the termination; · to reveal the main factors of possible abuse of rights under the termination by the employees and employers; · to suggest some directions for development of labor law mechanisms in regard to employee assurance during the termination of employment agreement. The main conclusions and results are based on: - specification of conceptual framework of employee assurance during the termination of employment agreement; - expansion of: 1. possibilities to keep the employees on the staff after termination because of redundancy; 2. the list of assurance during the termination of employment agreement, according to employees’ sectoral affiliation - expanding of: 1. standards on the ban of discrimination in payment for labor for standards on the ban of discrimination in the sphere of employee assurance after termination; 2. experience of providing some additional assurance under the termination for all the people with family obligations; - activization of the labor union organization role.
