Protection of Family Rights

This study is devoted to the protection of family rights of citizens. Protection of family rights is one of the important tasks regulated at the state level. So according to Article 7 of the Constitution of the Russian Federation "In the Russian Federation, state support is provided for the family, motherhood, fatherhood and childhood." Lack of the necessary protection can have a negative effect on the relationship of family members, as well as the stability of the marriage. Currently, in Russian legislation there are problems related to the protection of family rights, the definition of the family and family relations, there is uncertainty about how to protect the legitimate rights and interests of citizens and minor children. In the first chapter of this study, such concepts as “family”, “family relations”, the concept and types of property and personal non-property rights of citizens will be considered. The second chapter of the study is devoted to the protection of family rights of citizens, the definition of ways and methods of protecting family rights of citizens. Special attention in this chapter is paid to the peculiarities of protecting the family rights of minor children, since they are the most vulnerable category of citizens. The third chapter of the study is devoted to the peculiarities of the regulation of family relations at the international level. The author compares the implementation of the protection of the rights of citizens in the Russian Federation and in other foreign countries, gives examples from judicial practice. In conclusion, the author comes to several conclusions about what changes should be made in Russian legislation and in the system of protection of family rights in general, in order to increase the level of protection of family rights of citizens.
