Issues Related to Summary Proceedings in Civil and Commercial Procedures

The summary proceeding has the great practical significance nowadays because a large part of disputes can be resolved in this kind of procedure. Features of summary proceedings both in commercial and civil procedure are concluded in the accelerated and simplified character of the procedure, the adjudication without the court hearings and the limited list of cases for that procedure. The research of the summary proceeding is actual nowadays because there have been significant changings in Russian procedure legislation recently. Therefore, in the Code of Civil Procedure of the Russian Federation the institute of summary proceeding appeared and the scope of rules of the summary proceeding was greatly expanded in Commercial Procedure Code according to the Federal law of 02.03.2016 N 45-FZ. The following aspects were uncovered in the research: the concept and legal nature of summary proceeding, the features and types of this proceeding, the comparison of the summary proceeding in civil and commercial law. The theoretical and practical problems of summary proceedings in civil and commercial procedures were analyzed and the solutions were suggested.
