Procedural Aspects of Domain Disputes Resolution in the Russian Federation

The main purpose of this graduate paper is a comprehensive study of the procedural aspects of domain disputes resolution by commercial courts and courts of the general jurisdiction in Russian legal reality. To achieve this purpose, there are following tasks of the research: (1) to conduct a comparative legal analysis of the legal nature of the domain name; to systematize and present possible solutions to the issue of the uncertainty of the legal nature of the domain name in the Russian legal system; (2) to conduct a brief theoretical and conceptual analysis of the concept of a domain dispute in accordance with the conclusions of current law enforcement practice, Russian doctrinal developments; to identify the main types of such disputes and existing pre-trial procedures for their settlement; (3) to identify the features of domain disputes resolution: (3.1) to study the features of jurisdiction; (3.2) subject composition; (3.3.) to define the subject matter of proof and (3.4) the application of interim measures in cases of this category. The main conclusions were made on the basis of the analysis of scientific sources, legal acts and judicial practice on the topic at the end of this research.
